Intellectual Property Policy

1. Introduction

Welcome to AvenueSpot. This Intellectual Property Policy outlines how intellectual property (IP) rights are handled on our online marketplace for renting rooms and partitions (the "Platform"). 

AvenueSpot ("AvenueSpot," "we," "us," or "our") is committed to protecting its own intellectual property and respecting the intellectual property rights of others. 

This policy explains what constitutes intellectual property on our Platform, how user-generated content is treated, and the procedures for reporting and addressing intellectual property infringement. 

By accessing or using AvenueSpot, you agree to comply with this policy, in conjunction with our Terms of Use, Privacy Policy, and other applicable policies. 

2. AvenueSpot's Intellectual Property

All content, features, and functionality on the AvenueSpot Platform, including but not limited to the AvenueSpot name, logo, designs, software, text, graphics, images, video, audio, icons, and the compilation thereof, are the exclusive property of AvenueSpot or its licensors. 

This intellectual property is protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws worldwide. 

You are strictly prohibited from using, reproducing, distributing, modifying, creating derivative works of, publicly displaying, publicly performing, republishing, downloading, storing, or transmitting any of AvenueSpot's intellectual property without our prior written consent. 

3. User-Generated Content (UGC) and Intellectual Property

The AvenueSpot Platform allows users to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("User-Generated Content" or "UGC"). This includes, but is not limited to, listing descriptions, photos of properties, and communications. 

3.1. Ownership of UGC:

You retain full ownership of any intellectual property rights that you hold in your User-Generated Content. 

3.2. License Granted to AvenueSpot:

By uploading, posting, or otherwise making available any UGC on the Platform, you grant AvenueSpot a worldwide, non-exclusive, royalty-free, transferable, and sub-licensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such UGC in connection with the operation, promotion, and improvement of the AvenueSpot Platform and services. 

This includes, for example, displaying your listing photos in search results or on our social media channels to promote the platform. 

This license continues even after you delete your account or remove your content, but only for the purposes for which it was originally used (e.g., if a listing photo was used in an archived promotional material). 

3.3. User Responsibilities for UGC:

You represent and warrant that you either own all intellectual property rights in your UGC or have obtained all necessary rights, licenses, consents, and permissions to grant the license described above to AvenueSpot. 

You further represent and warrant that your UGC does not infringe upon or violate the intellectual property rights, privacy rights, publicity rights, or any other rights of any third party. 

You are solely responsible for the content you post and any consequences arising from its publication. 

4. Reporting Intellectual Property Infringement

AvenueSpot respects the intellectual property rights of others and expects its users to do the same. 

We respond to notices of alleged copyright infringement that comply with applicable law, including the Digital Millennium Copyright Act ("DMCA") if applicable, or similar international intellectual property laws. 

If you believe that your intellectual property rights have been infringed by content on the AvenueSpot Platform, please send a "Notice of Claimed Infringement" to our designated agent with the following information: 

4.1. Required Information for Notice:

  • Identification of the copyrighted work or other intellectual property that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works. 
  • Identification of the material that you claim is infringing (or the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit AvenueSpot to locate the material (e.g., URL of the listing/content). 
  • Information reasonably sufficient to permit AvenueSpot to contact you, such as an address, telephone number, and, if available, an email address. 
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. 
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. 
  • Your physical or electronic signature. 

4.2. Sending Your Notice:

4.3. AvenueSpot's Response to Infringement Claims:

Upon receipt of a valid and complete infringement notice, AvenueSpot will investigate the claim. 

We reserve the right to remove or disable access to the allegedly infringing material without prior notice. 

We may also, in our sole discretion, suspend or terminate the accounts of users who are found to have infringed the intellectual property rights of others. 

AvenueSpot is not responsible or liable for any intellectual property infringement by users on the Platform. 

5. Counter-Notification Procedure

If your content has been removed or disabled as a result of an infringement notice, and you believe the removal was a mistake or that you have the right to use the material, you may send a "Counter-Notification" to our designated agent. 

5.1. Required Information for Counter-Notification:

  • Identification of the material that has been removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or disabled. 
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled. 
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court located in Dubai, UAE, and that you will accept service of process from the person who provided the original notification of the alleged infringement. 
  • Your physical or electronic signature.

6. Repeat Infringers Policy

AvenueSpot has a policy of terminating user accounts that are determined to be repeat infringers of intellectual property rights. 

7. Disclaimer

AvenueSpot is a platform that relies on its users to comply with intellectual property laws. 

We do not proactively monitor all content for infringement. We rely on rights holders to report alleged infringements through the process outlined above. 

AvenueSpot is not liable for any infringement committed by its users.
